Congress passed the Americans with Disabilities Act Amendments Act (ADAAA) and it became law in January 2009. The law expands the definition of the term “disability” and significantly enables more individuals alleging disability-based employment discrimination to establish that they are disabled under the ADA. To that end it has altered the way employers must deal with an employee who claims a “disability.”
