Families First Coronavirus Response Act: Employer Paid Leave Requirements

The Families First Coronavirus Response Act (FFCRA or Act) requires certain employers to provide their employees with paid sick leave or expanded family and medical leave for specified reasons related to COVID-19. The Department of Labor’s (Department) Wage and Hour Division (WHD) administers and enforces the new law’s paid leave requirements. FLSA Staff Reduction Guidelines (COVID-19) for Medical Practices 

This PDF document offers guidelines to help medical practice handle staff reductions for non-exempt hourly employees and exempt salaried employees. This information is for educational purposes only. Please contact your local attorney for advice as specific scenarios should be handled on a case-by-case basis; state guidelines might apply.

Important reminders: Determine with the physician(s) what staff they need to cover the expected workload. Check with your broker regarding if insurance plans will continue to cover employees with temporary reduced work schedules. Check with your local state unemployment office regarding partial/full unemployment due to temporary reduced work schedule. FMLA Emergency Family Medical Leave Expansion Act

Congress has now enacted the “Families First Coronavirus Response Act” (the “Act”).
The FFCRA contains two separate laws that impose paid family and sick leave obligations on employers with fewer than 500 employees.
